On November 3, 2005, “Judge [Leonie] Brinkema, who was still presiding over the [potential terrorist Zacarias] Moussaoui trial, issued a modified order to the government to produce any video- or audiotapes of U.S. interrogations of terror suspects. …the Bush Administration told the judge it had no such tapes. …Sometime during that month, Jose Rodriguez Jr., the head of the CIA’s clandestine operations, ordered subordinates to destroy the tapes. Depending on the circumstances, the act was potentially a serious felony.”
