“The ABA [American Bar Association] adopted two different sets of recommendations with regard to the Bush Administration’s torture policy. In August [9] 2004, the ABA urged the U.S. government to comply with ‘…the Constitution and laws of the United States and treaties to which the United States is a party, including the Geneva Conventions of August 12, 1949’ and the CAT [United Nations Convention Against Torture], to ensure that no U.S. detainee is subjected to torture or other cruel, inhuman or degrading treatment or punishment. The ABA also asked that the U.S. amend 18 U.S.C. §§2340(1) and 2340(A) to prohibit all torture, regardless of the interrogator’s underlying motive or purpose. Finally, the ABA recommended that the President and Congress establish a bipartisan commission to investigate the Administration’s policy.”
