“…the DOJ’s [Department of Justice’s] professional conduct investigation of [Assistant Attorney General Jay] Bybee and [Deputy Chief in the Office of Legal Counsel John] Yoo [on July 29, 2009] exonerated them from professional misconduct, thus precluding bar associations’ ethics committees to consider the discipline of these two lawyers. It was concluded that the two lawyers in question had acted in violation of professional conduct standards, and that upon review by a longstanding DOJ prosecutor, the determination was reduced from professional misconduct to merely ‘poor judgment.’ ”
