“In June [29] 2006, in Hamdan v. Rumsfeld, a 5-3 majority of the Supreme Court held that [President] Bush’s military commissions did not meet the standards set out in the Uniform Code of Military Justice (UCMJ). In effect, the Court tossed back to Congress the question of precisely how and whether to conduct military commissions, with some general instructions on issues of procedure that the Court found troubling and in need of further congressional authorization.”
