On December 28, 2001, Office of Legal Counsel Attorney John Yoo sent a memorandum to General Counsel William “Haynes advocating that U.S. federal courts would not be able to hear habeas corpus petitions of aliens held at Guantanamo Bay Detention Center. This early memorandum demonstrates the purported conspiracy’s intention to keep the detainees in a place where they would not be afforded the protection of legal review.”
